By law, New Jersey courts must look at 11 different factors when deciding alimony, including the parties' incomes and previous lifestyle, the duration of the marriage, the health and education level of the parties and the equitable distribution of property.
Permanent Alimony ▪ Rehabilitative Alimony ▪ Limited Duration Alimony
Is a party self-employed? Did the marriage last just a few years, or did it last for decades? What are the true incomes of the parties? Our attorneys can assess whether you should pursue permanent, rehabilitative or limited duration alimony:
- Permanent alimony: This type of alimony is reserved for long-term marriages where there is a disparity of income between the parties.
- Rehabilitative alimony: The goal with rehabilitative alimony is to support the nonincome-earning spouse until he or she is self-supporting. This may include providing financial support so that a spouse can go to school for the training she or he needs to be self-supporting. Rehabilitative alimony is temporary.
- Limited duration alimony: Limited duration alimony is for shorter-term marriages where there is disparity of income but where the supported spouse has enough education, skills or training to become self-supporting. Alimony is paid at a specific amount for a specific number of years.
