Business Valuations and Division
Morristown Business Valuation Lawyers
New Jersey Business Division Attorneys
Division of a family business, professional practice or other privately-held company can be a complicated endeavor. In the most contested divorce cases, the parties may have separate valuations done, often leading to conflicting results. Even in uncontested divorce cases, forensic experts may be necessary in order to derive a proper value for your business.
It is very important to work with a Morristown business valuation attorney who understands the intricacies of complex property division and business valuations. At the family law firm of Laufer Dalena Cadicina Jensen & Boyd, we have extensive experience representing divorce clients who own businesses and/or spouses of business owners. Valuing the Business
There are three valuation approaches allowed by the court: the income/capitalized method, the market method, and the cost approach method. Each method can lead to a different result. An experienced divorce lawyer will examine your situation and help you strategically select the method that best meets your interests.
Valuating a medical practice, legal practice, restaurant or other business for purposes of a divorce is very different than valuating for purposes of selling the business. There are multiple factors that must be taken into account, including:
- If the company is the private company, how should it be valued — what method should be used?
- If the company is a public company, what is the value of the stock on the open market?
- If the business is a large practice, how will each member of the firm's interest impact the valuation? What compensation and perks are other partners receiving?
- During valuation of a partnership, do any of the partnership agreements affect valuation or division?
Dividing the Business
Once the business has been valued, the court will consider it as part of the equitable distribution of the marital property. How it will be divided depends on what will happen with the business: Does one spouse want to keep the business? Will the business be dissolved? Our goal is to help you negotiate and work through the details of your business valuation and division effectively and efficiently.
